By submitting an offer, the Supplier confirms that he is aware that:
1. The proceedings are conducted on the basis of the GPT applicable in Cersanit S.A., the Civil Code and other mandatory provisions of
law.
2. GPT shall apply to the implementation of the concluded Agreement to the extent not regulated separately by the Parties in the Bidding
Process. Submission of an Offer is tantamount to acceptance of the GPT by the Supplier.
3. The choice of the Offer shall be synonymous with the conclusion of the Agreement between the Parties to the Bidding Procedure.
4. Cersanit S.A. provides for the possibility of conducting an electronic auction in which all or only selected Suppliers will participate. The
end of the auction is not tantamount to the end of the Bidding Procedure and the selection of the Offer.
5. If the subject of the Bidding Procedure is a Work within the meaning of the Copyright and Related Rights Act, the condition for concluding
the contract is to send within 7 days a contract for the transfer of property rights on the provided template, signed in accordance with
the principles of representation, or by proxy - then together with the contract a copy of the power of attorney granted in writing to the
person who has signed the contract for the transfer of property rights should be sent to the following address: Cersanit SA, Al.
Solidarności 36, 25-323 Kielce, Poland with the name of the employee of Cersanit S.A. conducting the purchasing procedure (condition
precedent). Failure to sign and send the contract for the transfer of proprietary copyrights (together with a power of attorney, respectively)
to the address indicated will be tantamount to considering the contract not concluded by the Parties.
